The following describes the terms on which ARTIST-INK.COM
offers its services, and describes the legal relationship
between you(“you or “member”)
and ARTIST-INK.COM (“website” or “ARTIST-INK.COM”)
regarding music, artwork and writing(“material”)
submitted to the website. By joining(submitting
registration information) you are agreeing to
the clauses set forth by this document. The services
(hereafter referred to as “Services”)
offered by ARTIST-INK.COM are provided to you
under these terms and conditions. ARTIST-INK.COM,
at its discretion, may modify or discontinue the
Services which it provides. BY REGISTERING AS
A MEMBER OF ARTIST-INK.COM, YOU AGREE TO BE BOUND
BY ALL OF THE TERMS AND CONDITIONS SET FORTH HEREIN.
YOU AGREE TO USE THE SITE IN A MANNER WHICH IS
CONSISTENT WITH ALL OF THE TERMS AND CONDITIONS
DISCUSSED BELOW, AND IN A MANNER IN ACCORDANCE
TO ALL APPLICABLE LAWS AND REGULATIONS. If you
do not agree with any aspect of the terms below,
do not use the website or any of its Services.
TERMS AND CONDITIONS of MEMBERSHIP may be modified
at anytime, without any specific notice to you.
You agree that it is your responsibility to know
the TERMS AND CONDITIONS of MEMBERSHIP and Service
and periodically check it for any modifications.
The most current version of this document will
be posted on the website.
TERMS OF MEMBERSHIP
Membership is provided to artists, musicians
and writers who create material that follows the
ARTIST-INK.COM guidelines, all applicable laws
and regulations and register with the website.
The Membership and its Services areprovided to
individuals only and is for personal use only.
By joining you are agreeing that you:
1) will provide your real name for the purpose
of account creation,
2) are at least 13 years old (Please see Child’s
Privacy Act for more info.).
3) grant ARTIST-INK.COM a license(royalty free,
non-exclusive, non-withdrawable, world-wide) by
which the site may publish, modify, and reproduce
all materials provided to the website for the
sole purpose of showing it on the website.
MODIFICATION
ARTIST-INK.COM reserves the right to modify or
discontinue the Services which it provides. The
aforementioned modification can be done at any
time on both a temporary or permanent basis, can
be done with or without notice to you and applies
to, but is not limited to, any document, information
or other content on the website. You agree that
ARTIST-INK.COM shall not be liable to you or any
third party for any modification, suspension or
discontinuance of the Services, any documents,
information or other content on the Website.
TERMINATION OF SERVICE
ARTIST-INK.COM reserves the right to terminate
or suspend your Membership, and/or your use of
our Services, without notice and for conduct that
violates this Agreement, policies or guidelines
set forth by other areas of this Website, and/or
for any reason that the maintainers of this Website
determine appropriate. Reason include, but are
not limited to, violation of the Terms of Service
and Use, engaging in any conduct that the maintainer
of this Website believes is in violation of any
applicable law or regulation or doing anything
that is otherwise harmful.
MEMBER GUIDELINES
In exchange for granting a license(royalty free,
non-exclusive, non-withdrawable, world-wide) to
ARTIST-INK.COM to use submitted on the Website,
ARTIST-INK.COM provides Members a place on the
internet to display work. ARTIST-INK.COM does
not judge material submitted by members on a merit-base,
it does however, reserve the right to reject or
remove any material that it finds unacceptable.
The decision of ARTIST-INK.com is final.
The following list has examples of the type of
content/material that will be removed or rejected.
1. Any material containing explicit pornography.
2. Any material that is perceived by ARTIST-INK.COM
as abusive, profane or offensive(ie. expressions
for bigotry, prejudice, racism, hatred or excessive
profanity, any obscene, filthy, excessively violent,
harassing, or otherwise objectionable content)
3. Any material that is copyrighted by someone
other than the person submitting it (ie. any content
that infringes or violates any copyright, patent,
trademark, service mark, trade name, trade secret,
or other intellectual property right of any third
party)
4. Any material that ARTIST-INK.COM finds inappropriate.
While using the Service you must comply with applicable
laws at all times. You assume total responsibility
and risk for yourself. You retain all copyright
and other rights to the material submitted to
the Website, other than the license (royalty free,
non-exclusive, non-withdrawable, world-wide) you
grant ARTIST-INK.COM through this agreement. By
joining you agree that ARTIST-INK.COM is not responsible
for the content that you (the Member) submit.
Guaranteeing that submitted artwork follows all
applicable laws and regulations is the sole responsibility
of the Member. ARTIST-INK.COM does browse through
the material when processing applications, but
it does not review all of the material. By submitting
the material, Members state/guarantee that they
are the originator of the work (ie. the copyright
to the work is not owned by someone else) and
that they are responsible for it.
DISCLAIMER OF WARRANTIES.
By joining, you agree that the use of the service
provided by ARTIST-INK.COM is at your sole risk.
The service is provided on an ‘as is’
and ‘as available’ basis. ARTIST-INK.COM
disclaims all warranties of any kind, whether
they are expressed or implied. ARTIST-INK.COM
makes no warranty or guarantee in regard to the
Service provided, or information and/or products
obtained through the Website, or third parties
and advertisers that may be accessed through the
Website. Responsibility or liability for any losses
or damages arising from the use of the Website
and/or Service is disclaimed.
LIMITATION OF LIABILITY.
ARTIST-INK.COM has no liability for your use of
any information, service or products purchased
through the Website. ARTIST-INK.COM will not be
liable for any damages, whether they be direct,
indirect, incidental, or consequential. By joining,
you agree to indemnify ARTIST-INK.COM against
all claims and expenses.
INDEMNITY
By joining, you agree to indemnify and hold ARTIST-INK.COM
harmless from all claims, demands and expenses
that may arise out of the use of the Website and/or
Services. By submitting materials, you are stating
that you are the copyright holder. You are responsible
for any liabilities arising from the use of the
materials and you agree to indemnify ARTIST-INK.Com
and hold us and our affiliates, officers, co-branders
or other partners, and employees, harmless from
any claim or demand, that may arise out of the
use of the Website and/or Services.
GOVERNING LAW
This agreement shall be governed by the laws of
the State of New Hampshire and shall be treated,
in all respects, as a contract entered into and
wholly performed in the State of New Hampshire.
Any disputes arising from this agreement shall
be brought and maintained exclusively in any state
or federal court in the State of New Hampshire.
By using the Service, you agree to comply with
all of the Terms and Conditions set out in this
document. If you do not wish to accept this agreement,
do not proceed with the registration. |
